Terms of Service

If you are accessing the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

Your continued use of the Service after any modification to these Terms constitutes acceptance of those modifications.

2. Description of Service

AIPoster is a software-as-a-service platform that provides:

• AI-powered social media content generation using large language model APIs from multiple third-party providers;
• Scheduling and publishing of content across connected social media accounts;
• Brand profile management and multi-account team collaboration;
• Post performance analytics and engagement tracking;
• Image storage and media management.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

3. Account Registration and Security

You may register for an account using OAuth authentication through Google or GitHub. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately at airrakeshkumarsharma@gmail.com if you suspect unauthorised access to your account.

You may not share your account credentials with third parties, create multiple accounts to circumvent usage limits, or use automated means to create accounts.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not use the Service to:

• Generate, distribute, or schedule content that is unlawful, defamatory, obscene, hateful, or violates any applicable law or regulation;
• Harass, threaten, or abuse any individual or group;
• Spread misinformation, disinformation, or deliberately misleading content;
• Violate the terms of service of any social media platform to which you publish content;
• Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure;
• Use the Service to conduct spam campaigns or engage in practices prohibited by applicable anti-spam laws;
• Reverse engineer, decompile, or attempt to extract the source code of the Service.

We reserve the right to suspend or terminate accounts found to be in violation of this acceptable use policy.

5. AI-Generated Content Disclaimer

The Service uses artificial intelligence models operated by third-party providers to generate social media content based on your inputs. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, or unsuitable for your specific purposes;
• You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing it on any social media platform;
• AIPoster does not guarantee the accuracy, quality, or appropriateness of any AI-generated content;
• Publishing AI-generated content without review is done entirely at your own risk;
• You remain responsible for ensuring that all published content complies with applicable laws, platform policies, and your own obligations to your audience.

6. Intellectual Property

Your content:You retain ownership of all content, brand assets, and data you upload or create using the Service (“User Content”). By using the Service, you grant AIPoster a limited, non-exclusive, worldwide licence to process, store, and transmit your User Content solely as necessary to provide the Service. This licence terminates when you delete the relevant content or close your account.

Our platform: AIPoster and its licensors own all intellectual property rights in the Service, including its software, design, user interface, trademarks, and documentation. These Terms do not grant you any rights to use our trademarks or intellectual property beyond what is necessary to use the Service as permitted herein.

AI-generated outputs: The ownership of AI-generated content may be subject to evolving legal interpretation. You represent that you will comply with all applicable laws regarding AI-generated content and disclose its AI-assisted nature where required by law or platform policy.

7. Payment Terms

Certain features of the Service are available only on paid subscription plans. All payments are processed by Razorpay, a payment gateway regulated under the Payment and Settlement Systems Act, 2007 (India). By subscribing to a paid plan, you agree to the following:

• Subscription fees are charged in advance for each billing period (monthly or annual, as selected at checkout);
• Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date;
• All prices are stated in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise;
• You authorise AIPoster to charge your payment method on file for recurring subscription fees;
• Failure to pay may result in suspension or termination of your account.

8. Data Processing

Your use of the Service involves the collection and processing of personal data as described in our Privacy Policy. By using the Service, you consent to such processing. Our Privacy Policy is incorporated into these Terms by reference.

9. Third-Party Services

The Service integrates with third-party services to deliver its functionality, including but not limited to:

• AI providers: Anthropic (Claude), OpenAI, Google DeepMind (Gemini), and DeepSeek — your content is transmitted to these services for AI generation;
• Social media platforms: Platforms to which you connect your accounts (e.g., Twitter/X, LinkedIn, Instagram, Facebook) — your use of those platforms is subject to their own terms of service;
• Payment processing: Razorpay for subscription payments;
• Cloud infrastructure: AWS S3 for media storage and Neon (PostgreSQL) for database hosting.

AIPoster is not responsible for the practices, availability, or content of any third-party service. We encourage you to review the privacy policies and terms of service of all third-party providers whose services you access through AIPoster.

10. Limitation of Liability

To the fullest extent permitted by applicable law, AIPoster and its operators, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the Service.

In no event shall AIPoster’s aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Service exceed the greater of (a) the total subscription fees paid by you to AIPoster in the three months immediately preceding the event giving rise to liability, or (b) INR 1,000.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

You may terminate your account at any time by deleting your account through the account settings page. Termination of a paid subscription is subject to our Refund & Cancellation Policy.

We may suspend or terminate your access to the Service immediately, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or if required to do so by law. Upon termination, your right to access the Service ceases immediately. We will retain your data for a period consistent with our Privacy Policy and applicable legal obligations before deletion.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the “Last updated” date at the top of this page and, where reasonably practicable, by sending an email notification to the address associated with your account. Your continued use of the Service after such changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.
